Welcome to Horse and Balance Asia, a division of Vorgers Malessa Group Limited (“the Company”). These Sales Terms and Conditions (“Terms”) govern the sale of equestrian products and equestrian related products (“Products”) through our online store. By placing an order, you (“the Customer”) agree to be bound by these Terms. Please read them carefully before making a purchase.

We make every effort to ensure the accuracy of product descriptions, images, and prices on our website. However, errors or inaccuracies may occur. The Company reserves the right to correct any errors or omissions and to update product information without prior notice.

 

  1. Ordering Process

To place an order, you must:

  1. Hong Kong-Based Company and Tax Responsibilities

Horse and Balance Asia, as part of Vorgers Malessa Group Limited, is based in Hong Kong. Please note the following regarding taxes and international shipments: 

  • No Sales Tax in Hong Kong: There is no sales tax or value-added tax (VAT) on products sold within Hong Kong.
  • International Purchases: For customers outside of Hong Kong, any applicable import duties, taxes, or customs fees are the sole responsibility of the customer. These charges are not included in the product price or shipping fees and are not covered by Horse and Balance Asia.
  • Responsibility for Import Taxes: The customer is responsible for paying any import taxes, customs duties, or other fees required by their local government. We are not liable for any costs or delays caused by customs processing.

 

  1. Shipping and Delivery
  • We aim to ship in-stock items within 2 business days of order confirmation. We are not responsible for delays caused by third-party carriers.
  • Many items are custom-made or available on a pre-order basis. Delivery times for these items are average estimates and not guaranteed.
  • If delivery times are longer than expected, we will notify you. You have 24 hours from the notification to cancel the order at no charge. After this period, a cancellation fee of 30% to 50% of the order value may apply, depending on the product.

 

  1. Returns and Exchanges
  • We offer a 14-day return policy from the delivery date for items that are not custom-made or pre-ordered. Products must be unused, in original packaging, and accompanied by the original receipt.
  • Custom-made orders and pre-orders are non-returnable.

  • Return shipping costs are the customer’s responsibility unless the product is defective or incorrect.

 

  1. Warranty and Liability
  • Products may come with a manufacturer’s warranty. Please refer to the warranty information provided with your product.

**WAIVER OF LIABILITY AND DISCLAIMER OF WARRANTY**

By purchasing and/or using any products from Horse and Balance Asia, a division of Vorgers Malessa Group Limited ("the Company"), you ("the Customer") acknowledge and agree to the following terms and conditions. This waiver of liability and disclaimer of warranty constitutes a legally binding agreement between you and the Company.

 

### 1. **Product Liability**

The Company shall not be held liable for any injury, damage, or loss to individuals or property arising from the ownership, possession, or use of any product sold or delivered by the Company. This includes, but is not limited to, any claims, actions, suits, proceedings, investigations, or complaints that may arise now or in the future. The Customer acknowledges that equestrian sports inherently involve risks, and the use of our products cannot eliminate or mitigate those risks. By purchasing and using our products, the Customer assumes all such risks.

### 2. **Disclaimer of Warranty**

The Company makes no warranties of any kind, whether express, implied, or statutory, regarding any product sold. This includes, but is not limited to, warranties as to the description, quality, merchantability, completeness, or fitness for a particular purpose of any products, or any other warranties that may otherwise be implied by law. All such warranties are hereby expressly excluded and disclaimed.

### 3. **Limitation of Liability**

In no event shall the Company be liable for any direct, indirect, punitive, incidental, special, or consequential damages, including but not limited to, loss of profits, revenue, data, or use, incurred by the Customer or any third party, whether in an action in contract or tort, arising from the use or misuse of the products sold by the Company. This limitation applies regardless of whether the Company has been advised of the possibility of such damages.

### 4. **Support and Assistance**

For any warranty issues related to a specific product, the Customer is advised to contact the respective brand’s customer service department directly. While the Company disclaims any liability or responsibility for such issues, we are available to assist the Customer in contacting the relevant brand should you require help. The Company’s assistance does not constitute an assumption of responsibility or liability for the product. 

### 5. Choking Hazard Acknowledgment and Waiver  **
By signing this waiver, I acknowledge and understand that certain products, activities, or objects involved in the or with any product sold via Horse and Balance Asia part of Vorgers Males group may pose a risk of choking, particularly for young children or individuals who may accidentally ingest small parts.

I acknowledge that:

  1. Choking Risk: Small parts or items included in or associated with any product sold via Horse and Balance Asia part of Vorgers Males group can present a choking hazard. I understand that these risks may be higher for children under the age of 3 years.

  2. Supervision: I agree that it is my responsibility to supervise any child or individual who may be at risk of choking and to ensure that such individuals do not come into contact with small objects that could pose a choking hazard.

  3. Assumption of Risk: I voluntarily assume all risks associated with the potential for choking and understand that company Horse and Balance Asia part of Vorgers Males group is not liable for any injury, harm, or damage caused by failure to properly supervise or manage the use of small parts or objects.

  4. Release of Liability: I release and hold harmless Horse and Balance Asia part of Vorgers Males group from any claims, damages, or losses arising from any choking incident, whether resulting from negligence or otherwise.

** Tax & Duties SPECIAL LEGAL NOTE**

Hong Kong Based Company and Tax Responsibilities

Horse and Balance Asia operates as a division of Vorgers Malessa Group Limited, which is based in Hong Kong. As a Hong Kong-based company, we want to inform you of the following important details regarding taxes and international shipments:

  1. No Sales Tax in Hong Kong

There is no sales tax or value-added tax (VAT) applied to products sold within Hong Kong.           

  1. International Purchases

For customers purchasing products from countries outside of Hong Kong, please be aware that any applicable import duties, taxes, or customs fees imposed by your country are the sole responsibility of the customer. These additional charges are not included in the price of the product or shipping fees and are not covered by Horse and Balance Asia.

  1. Responsibility for Import Taxes

It is the customer’s responsibility to pay any import taxes, customs duties, or other fees required by their local government when receiving international shipments. We are not liable for any such costs or delays caused by customs processing in the destination country.
